JAMMU, OCT 7: A Special NIA Court in Jammu has declared a wanted terror accused, believed to be hiding in Pakistan, a proclaimed offender following an application filed by the National Investigation Agency (NIA).
The accused, Nazir Hussain, a resident of Hari village in Poonch district, is wanted in a terror conspiracy case being investigated by the NIA following the recovery of several grenades from an alleged overground worker in the Surankote area in October 2024.
According to the investigation, the grenade consignment was allegedly sent from across the border by Hussain for carrying out blasts. Investigators said he is also known by several aliases, including Ali Khan, Nasir, Naziru and Shaheen.
Special Judge (NIA), Jammu, Prem Sagar, declared Hussain a proclaimed offender under Section 84 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) after hearing the NIA’s application on October 1.
The court noted that non-bailable warrants had earlier been issued against the accused. However, the warrants could not be executed as Hussain was not found at his residence.
According to the execution report submitted by the NIA, the accused had absconded to Pakistan and remained unavailable to the authorities.
The court observed that despite efforts by the prosecution, including publication of notices in newspapers and the official Gazette of Jammu and Kashmir, Hussain neither appeared before the court nor surrendered.
The court concluded that the circumstances indicated that the accused had deliberately evaded arrest, leading to his declaration as a proclaimed offender.
