Jammu, Aug 06: Amid growing speculation surrounding the tenure of Lieutenant Governor Manoj Sinha, constitutional and legal provisions reaffirm that the position of a Lieutenant Governor in any Union Territory, including Jammu and Kashmir, carries no fixed term.
Legal experts referencing Article 156 of the Constitution of India explain that while a Governor of a state is appointed for five years and holds office at the pleasure of the President, the Constitution remains silent on the tenure of a Lieutenant Governor. This silence indicates that a Lieutenant Governor’s service can extend beyond five years, depending solely on the President’s discretion.
Article 239, which governs the administration of Union Territories, empowers the President to appoint an administrator—often designated as Lieutenant Governor—without any prescribed term limit. This allows the LG to continue in office indefinitely unless a replacement is appointed by the President.
The Jammu and Kashmir Reorganisation Act, 2019, also supports this interpretation. Enacted on August 9, 2019, the Act states that the Governor of the erstwhile state would serve as the Lieutenant Governor of both Jammu and Kashmir and Ladakh for a period determined by the President. The language of the legislation does not specify any duration for this appointment.
Official documents from August 6, 2020, when Manoj Sinha was appointed as the Lieutenant Governor of Jammu and Kashmir, confirm that the President’s order did not mention any time-bound tenure. Sinha formally assumed office on August 7, 2020, at Raj Bhavan, Srinagar, succeeding G.C. Murmu.
Under Section 53 of the Reorganisation Act, the Lieutenant Governor of Jammu and Kashmir holds considerable authority, including matters related to the All India Services and the Anti-Corruption Bureau. The LG’s decisions in such areas are largely beyond judicial review, further reinforcing the autonomy and enduring relevance of the office.
Manoj Sinha, known for being the first political appointee as LG in Jammu and Kashmir, is a three-time Member of Parliament. He was elected in 1996, 1999, and 2014. During his final term, he served as Minister of State for Railways and later as Minister of State (Independent Charge) for Communications in 2016.
Despite speculation, constitutional clarity and supporting statutes confirm that Manoj Sinha can continue to serve as the Lieutenant Governor of Jammu and Kashmir for an undefined period, unless otherwise decided by the President.
