JAMMU, Feb 6: Chief Minister Omar Abdullah on Thursday formally tabled “The Jammu and Kashmir Anand Marriage Registration Rules, 2023” in the Legislative Assembly, fulfilling the mandate under Section 6(4) of the Anand Marriage Act, 1909 (Central Act 7 of 1909).

This significant step streamlines the registration process for Anand Marriage ceremonies, primarily observed by the Sikh community, ensuring legal recognition, authenticity of unions, and protection of spousal rights, inheritance, and social entitlements.

The rules, notified in 2023 after extensive consultations, establish a structured framework for solemnization and documentation. Key provisions include designated registrars (often Sikh religious leaders or gazetted officers), mandatory witnesses, prescribed formats for applications and certificates, timelines for registration (within 30 days), and provisions for delayed filings with valid reasons.

By aligning J&K with the central Anand Marriage Act—originally enacted over a century ago to validate Sikh marital customs outside Hindu rites—the move addresses long-pending demands from the Sikh community in the region. It prevents disputes over marriage validity, especially in matters of property, divorce, or succession, and integrates seamlessly with existing civil registration laws.

Abdullah’s tabling underscores the J&K government’s commitment to minority rights, cultural preservation, and administrative efficiency post-Article 370 changes. The rules empower Sub-Registrars at district levels to maintain digital records, issue extracts, and handle corrections or appeals, promoting transparency and accessibility.

This development coincides with broader governance reforms in the Union Territory, including recent budget announcements on social harmony. Once laid, the rules invite assembly scrutiny, potential amendments, and public feedback before full enforcement.

The Anand Marriage Act, a cornerstone of Sikh identity since 1909, recognizes the Guru Granth Sahib as the eternal Guru and Laavan Path as the holy matrimonial rite—now legally fortified in J&K for generations ahead.
